Different bankruptcies

There are two primary types of bankruptcies, a chapter 7 and chapter 13.

Chapter 7

In a chapter 7 you are usually discharging your balance on all items you choose to include that are dischargeable and were open before the date of filing. This type of bankruptcy typically gets discharged quickly, usually in just over 3 months your dischargeable debts are completely forgiven.

WHAT TO KNOW:

It’s usually best to buy a car after filing a chapter 7 bankruptcy because lenders that specialize in this type of financing look differently at someone who just filed. Once filed the lender knows they are not going to be included in the bankruptcy and the consumer no longer owes most or all of their previous debts. Chapter 13

A chapter 13 bankruptcy is a reorganization of debts where you keep your property and assets, but are requesting a modified repayment plan for a period of time usually up to 5 years in which you pay a bankruptcy trustee, who in turn pays your creditors.

WHAT TO KNOW:

Because an approved chapter 13 stays open longer as you need to pay your loans according to plan before the bankruptcy is discharged. You must go through the process of getting lender and court approval before actually buying a car.
